  1. Purpose and scope of the Privacy Policy (Introduction)

We, Coco and Kandy Ltd. (“Coco and Kandy”, “we”, “us” or “our”), UIC 205757034, with seat and address of management in Varna 9000, 11 Yosif Stoyanov St., are the owners of the www.cocoandkandy.com website (the “Website”). In operating the Website we process your personal data in our capacity as personal data controller, as defined in the General Data Protection Regulation (EU) 2016/679 (the “GDPR”). We are committed to protecting your privacy in accordance with applicable data protection laws. When we write “you”, we mean you as our customer, website visitor or other relevant third party such as the contact persons of a company or other organisation we are doing business with and the like. The purpose of this Privacy Policy is to explain how we collect and use your personal data as well as how you can exercise your rights.

Any information you as user of the Website provide is received, stored and managed by us in line with this Privacy Policy.

We may update this Privacy Policy from time to time without prior notice to you. If we make changes, we will notify you by revising the date at the top of the policy in cases where the changes are not substantial or by providing more prominent notice for substantial changes, as appropriate.

Commercial Information, such as details on the items added to the shopping cart/purchased/returned, order history.

Payment information or billing information in connection with your use or purchase of our goods and services, bank details for debit and credit cards and PayPal (credit and debit card numbers from online transactions are not saved and stored).

5. To whom do we disclose your personal data?

Coco and Kandy will never share, sell or rent your information to third parties for their direct marketing purposes.

We may disclose information collected from and about you as follows (subject to applicable laws):

  • With vendors, consultants and other service providers who use the information on our behalf solely to carry out our instructions and for no other purpose (e.g. website developer and support company – SGD, accounting firm, DHL, UPS – delivery, marketing agent who helps with Facebook and Google ads that do not send or use our customers’ data). These providers will act only on our instructions, will be subject to prior verification and will assume contractual obligations containing strict clauses regarding the protection of personal data. We strive to ensure that these third parties use personal data only for lawful purposes in accordance with this Privacy Policy;
  • To comply with a request for information by law enforcement, or to the extent required by applicable law, regulation or legal process; (to the extent that we are required to do so by law) in connection with any legal proceedings or prospective legal proceedings; and in order to establish, exercise or defend our legal rights;
  • If we believe there has been a violation of the Website Terms and Conditions, any user agreements or policies, or to protect the rights, property and safety of Coco and Kandy or a third party;
  • In connection with any proposed or actual merger, financing or sale or transfer of all or a portion of our assets or business to another entity;

For additional copies requested by you, we may impose a reasonable fee with respect to our administrative costs.

You are entitled to request from us to rectify your personal data that are inaccurate, and the completion of your personal data that are incomplete.

  • Right to restriction of processing

The restricted processing usually comes down to simply storing your personal data, and any other processing is suspended.

We will no longer process the personal data unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims.

Where your personal data are processed for direct marketing purposes, you have the right to object at any time. In case of such objection, we will no longer process your personal data for marketing purposes. In practice, you will usually expressly agree in advance to our use of your personal data for marketing purposes, and we will provide you with an opportunity to opt-out of the use of your personal data for marketing purposes. You can also manage your subscriptions by logging into your user account on our website, instruct us not to use your personal data for marketing purposes by email at any time or by following an “unsubscribe” link in our marketing messages.

We will perform the actions related to the satisfaction of your rights above free of charge, except if your demands are clearly unfounded or excessive, in particular due to their repeatability – in such cases we may impose a reasonable charge, with a view to our administrative costs, or may refuse to take action on your request.
